Filing a Personal Injury Claim in Connecticut
Connecticut Personal Injury Attorneys Representing Plaintiffs Since 1955
RisCassi & Davis, P.C. is the only personal injury law firm in Connecticut named a Top 50 Law Firm by the National Law Journal. Since 1955, we’ve represented only injured people, never insurance companies, and we’ve recovered over half a billion dollars for clients across hundreds of cases. Seven of our attorneys hold Board Certification in Civil Trial Law from the National Board of Trial Advocacy, a credential fewer than 3% of trial lawyers nationwide carry.
Connecticut personal injury laws allow people hurt by negligence to seek financial compensation for the full scope of their losses. That process may involve filing a claim with an insurer, negotiating a settlement, or pursuing a lawsuit when a fair resolution can’t be reached. We manage every step of that process so our clients can focus on recovery.
We travel throughout Connecticut to meet clients wherever they are, offer same-day appointments (including evenings and weekends by request), and work on a contingency fee basis: no fees or costs unless we win.
If you’d like to speak with a Connecticut personal injury attorney about your situation, call (860) 245-2412 or contact us online for a free, no-obligation consultation.

How to Tell If You Have Grounds for a Personal Injury Claim
While some accidents are truly unavoidable, many are entirely preventable. When another person, landowner, business, government entity, manufacturer, or other party is negligent or acts outside of the law and causes injuries and damages, the affected individuals may be able to take legal action.
In order to have grounds for a personal injury claim, you must be able to prove all of the following:
- The other person or party owed you a duty of care
- The other person or party breached that duty of care
- You were injured because of that breach
- You suffered measurable damages, whether economic or non-economic
For example, another driver on the road owes you a duty of care, meaning he or she has a responsibility to obey the law and take reasonable actions to avoid an accident. If the other driver breaches this duty of care, say by texting while driving, and causes an accident that leaves you injured, you may be able to file a personal injury claim and seek compensation for your resulting medical bills, lost wages, disability, pain and suffering, and more.
Under Connecticut General Statutes § 52-584, most personal injury lawsuits must be filed within two years from the date the injury was sustained or discovered, with an absolute outer limit of three years from the date of the negligent act. Deadlines can vary: claims against municipalities, product liability matters, and wrongful death cases may carry different notice requirements or filing windows. Insurance companies sometimes use delay tactics that can push claimants toward missing these deadlines. Consulting an injury attorney in Connecticut as early as possible can help protect your right to file. We offer free, no-obligation consultations to help you understand whether you have a viable claim.
