Defective Products
Defective and dangerous products have killed and injured many. RisCassi and Davis, P.C., have pursued claims under the Connecticut Product Liability Act against the manufacturers or sellers of a variety of products. We have brought claims against the makers of automobiles, tools, lawnmowers, snowblowers, woodchippers, chainsaws, heating equipment, toys and games, cribs, pools, and rescue equipment, among other products.
Medical devices and drugs are an important subgroup of product liability claims. We have brought claims against the makers of defective prosthetic devices and medical implements. We have successfully sued the sellers of prescription drugs that were mislabeled or had undisclosed dangerous side effects.
One of the positive effects of product liability litigation is enhanced product safety. We have seen that some of the defects identified in earlier cases have been corrected and additional safety devices installed, such as dead-man switches, automatic shut-off devices and guards. These changes have improved the safety of consumer and industrial products.
Many years ago, we unsuccessfully sought to impose liability for a homicide on the manufacturer of a particular semi-automatic weapon that was a favorite of criminals and that, we contended, lacked any legitimate purpose. The court did not accept our argument, but we can take some satisfaction in the later banning of the sale of that weapon here. Even though we lost that case, we remain proud of our efforts. We may have been ahead of our time but, in the wake of the tobacco litigation, similar cases are being brought today in various states. Even when initially unsuccessful, product liability litigation can have positive societal consequences.
